Judicial services to be provided by the court on Saturday and Sunday

Kathmandu. KATHMANDU: The Supreme Court has ruled that although the government has implemented the two-day holiday on Saturday and Sunday in a week, urgent judicial works would not be stopped during this period.

A full meeting of the Supreme Court (SC) on Friday decided to continue the important activities like permission to issue arrest warrants, approval of necessary arrest warrants and extension of time to detainees even during holidays.

Article 20 (3) of the Constitution of Nepal states that a person arrested must be produced before the judicial authority within 24 hours except the time limit and cannot be kept in custody without order. In order to implement this constitutional right, the court is going to serve on holidays as well.

According to the court, all the subordinate courts have been directed to make necessary arrangements for granting arrest warrants on holidays, supporting necessary arrest warrants and extending the custody of the accused.

The directive will be applicable to the Supreme Court, High Courts, District Courts, Special Courts, Administrative Courts, Labour, Consumer, Children’s Court and all other tribunals across the country.

This provision has been made as per the amendment to the Supreme Court Regulations-2074 BS and the ‘Court Management Directive-2075 BS’, stated the notice signed by Deputy Registrar Niranjan Pandey. This decision will not violate the constitutional rights of the accused due to public holiday.
