Kathmandu. The National Human Rights Commission (NHRC) has recommended action against former Prime Minister KP Sharma Oli and Gauri Bahadur Karki, chairman of the judicial probe commission formed to investigate into the Janji agitation (September 23 and 24).
The recommendation was made in the report of the committee formed under the coordination of NHRC member Lily Thapa to investigate the violation of human rights in the incidents of September 7 and 24. The CIAA has found that former Prime Minister KP Sharma Oli, former Home Minister Ramesh Lekhak and former Minister for Information and Communications Prithvi Subba Gurung have violated their human rights on the basis of the report.
In its report submitted to the Office of the Prime Minister and Council of Ministers on Wednesday, the commission has recommended that Oli, Lekh and Gurung have violated their human rights as per Article 249 (2) (c) of the Constitution of Nepal.
The Article of the Constitution states that if there is a need to file a case against a person or institution that violates human rights, it shall be recommended to file a case in the court as per the law. However, the NHRC has recommended that action be taken against them even if it is a retrospective law on the offence of humanity and human rights as there is no provision to punish them for human rights violations.
The NHRC has recommended making laws to take action against human rights violations, a maximum of six months imprisonment or a fine up to Rs 300,000 or both.
Likewise, the bill also recommended prohibiting human rights violators from running for political appointments or elected posts for at least five years, prohibiting them from holding administrative responsibilities for at least three years and banning them from travelling abroad for at least three years.
The NHRC has also recommended further investigation against former Prime Minister Sushila Karki and former Home Minister Sudhan Gurung for their involvement in human casualties in the Genji movement. “The NHRC has decided to conduct a thorough investigation into whether or not the demonstrators were disturbing public peace and order or not by their statements and whether or not they were disturbing public peace and order, and to inform the concerned persons and the general public and to investigate into the rights of the mentioned persons to a fair hearing and take action against those found guilty.”
The NHRC has also recommended further investigation into the case against Purushottam Yadav, Sabal Gautam, Ankit Malla, Khemraj Saud and Sudhan Gurung, president of Hami Nepal.
The NHRC has recommended investigation into Rastriya Swatantra Party (RPP) President Rabi Lamichhane for his involvement in sending prisoners out of jail during the Genji movement. The report has also recommended that along with Lamichhane, Satyaraj Joshi of Nakkhu Prison and lawmakers Manish Jha and Hari Dhakal should be brought under investigation.
The commission has also recommended probe against Gauri Bahadur Karki, chairman of the judicial probe commission formed by the then government to investigate into the Jenji movement. The report has recommended investigation into Karki’s involvement in the acts including human and physical damage and whether his statement had any impact on the demonstrators.
During the Zenji movement, Karki had also protested for making provocative statements on social media. The opposition parties have been protesting that the Karki Commission has submitted its report to the government only after investigating the incident of September 23.
