Kathmandu. The government is going to introduce a system of ‘probit test’ to make constitutional and political appointments transparent and impartial.
Second National Strategic Plan Against Corruption (FY 2082) prepared and unveiled by the Office of the Prime Minister and Council of Ministers. 83–87. It has been proposed to bring this provision in the draft of Article 88. Probity test is done to check whether a person being appointed to any constitutional or political post is capable, qualified and capable of making decisions. Although the practice of probity test is being practiced in other countries, it has been proposed to start only in Nepal.
The draft has proposed making constitutional appointments more systematic and transparent, including probity test to test the honesty, impartiality and morality of the appointees. The Constitutional Council, the Public Service Commission and the Provincial Public Service Commission have been designated as the responsible bodies for maintaining this provision, while the parliamentary committees, the Commission for the Investigation of Abuse of Authority and the Office of the Attorney General have been designated as the supporting bodies. It has been proposed to bring this system within 1-2 years.
Similarly, the impeachment proceedings for office-bearers of constitutional bodies and justices of the Supreme Court should be finalized within two months of the impeachment motion being registered and if the impeachment motion is passed, necessary legal provisions would be made to recommend an investigation into the impeachment and corruption offense. The Ministry of Law, Justice and Parliamentary Affairs is the responsible body for this, while the Federal Parliament Secretariat, the Constitutional Council, the Commission for the Investigation of Abuse of Authority and the Office of the Attorney General are the supporting agencies. This arrangement will be made within 1 year.
Likewise, the government has stated that criteria will be prepared and implemented to make all political appointments in public bodies fully qualified by maintaining uniformity in the subject area. The Office of the Prime Minister and Council of Ministers is the responsible body and the Ministry of Law, Justice and Parliamentary Affairs has been designated as the supporting body for this. This standard will be prepared within 1 year and the government has a policy to continue its implementation.
