18 Commodity Associations Seek Instant Voting Rights

KATHMANDU: Commodity associations of Nepalese Chambers of Commerce and Industry (FNCCI) have demanded immediate voting rights for the membership of the Federation of Nepalese Chambers of Commerce and Industry (FNCCI). Organising a press conference on Friday, they said that as per the FNCCI statute, they should have participated in a general assembly to participate in the election after the Patan High Court on Thursday issued an interim order to allow 18 commodity associations to participate in the election.

A total of 18 commodity associations, who got justice from the court yesterday, have already participated in the FNCCI’s special general and 59th annual general meeting. Also, they have paid all the membership fees.

The Supreme Court (SC) has issued an interim order directing all the members to participate in the upcoming 60th annual general meeting of the FNJ.

Here are the grounds for the exercise of franchise presented by them: 1. We had filed applications with necessary documents for membership on different dates before the decision was taken to grant membership of the Federation by the mentioned organizations. 2. On 2081-11-24, the Membership Recommendation Committee submitted it to the Executive Committee for interpretation. 3. On 26.11.2008, the Executive Committee decided to give us membership in a formal manner. 4. Kishor Shrestha, on behalf of Nepal Pole Association, has filed a case against the decision of granting membership to the Honorable High Court, Patan. 5. Participated in the 59th General Meeting of the Federation held on 2081-12-28 with the order that no interim order was required to be issued in the said case.

6. The order dated 2082/09/16 issued directing the Federation to revoke the decision of distributing the membership without disclosing the facts and reasons while distributing the membership. 7. On top of that, we have filed a double petition in the honorable Supreme Court and the federation has also filed a double petition. 8. A petition was filed at the Federation on 12-04 not to proceed with the General Assembly until the case is finalized or the FNJ decides that we should participate.

9. The meeting of the Executive Committee of the Federation held on 2082-12-05 took a decision regarding the convention and called the convention without taking any decision regarding us. 10. On 12-12-22, 7 of our organizations filed an injunction petition arguing that the general meeting was illegal and an interim order was issued on 23rd of 2008. 11. After a double discussion on 2082-12-26, the Honorable Court issued an interim order stating that it was not lawful to hold the AGM without our participation.
