The government has approved the ‘Work Procedure on Remuneration and Social Security of Workers Associated with Public Procurement, 2083’.

The main objective of this new procedure is to ensure fair wages, social security and labor rights of workers working in industries and factories, consultancy, information technology and other public procurement sectors. It has laid the legal foundation for ending fraud, labor exploitation and workplace insecurity by middlemen.

Key Provisions of Procedure and Rights of Workers

1) Ensuring minimum wages and wages

The range of daily and monthly wages of the workers has been clearly determined on the basis of work and skill. Under this, separate rates have been fixed for construction and field workers, intellectual and professional and workers of industries and factories. In addition, apart from the prescribed minimum wage, the employer will also have to provide festival expenses, holidays and allowances equivalent to government services as per the prevailing law.

2) Compulsory Social Security Fund Affiliation

All contractors, suppliers and service providers participating in government contracts and public procurement will have to enroll their workers in the social security fund. Employers who are not included in the fund will be deprived of participating in the public procurement process. Daily wage earners and short-term workers will also be included in this system from day one.

3. The government’s contribution to social security

is 10 percent.

Out of the 20 percent social security contribution to be borne by the employer in construction work and consultancy services, 10 percent will be borne by the government and 10 percent by the employer. This will provide additional security to the workers and also reduce the financial burden on the businessmen.

4) Payment directly to the bank account

The wages of the workers will have to be deposited directly in their own bank accounts without intermediaries. The commission will not be deducted or deposited in the account and the amount will be withdrawn by pressuring. If the wages are not paid, the government will deduct the amount from the contractor’s payment and deposit the amount directly into the account of the worker.

5) Accident Treatment, Insurance and Workplace

Safety

Provision of safety equipment, clean drinking water, toilets and first aid has been made mandatory at the workplace. In case of an accident, it will be the responsibility of the employer to provide immediate rescue, treatment, insurance and rehabilitation.

6) Digital Archives and Engagement in the Formal Economy

All types of workers will be registered free of cost and identity cards will be provided and their details will be kept in the electronic system. If there is a change in employment or details, the workers will get information through SMS on mobile.

7) Affected Grievance Hearing System

In case of injustice, harassment or non-payment of wages to the workers, complaints can be made through oral, written or digital means. The employer has to settle the complaint within 7 days, and if it is not resolved, the local center and the labor office will take action. The identity of the complainant will be kept confidential.

Relief and Legal Standards for Businesses and Service Providers

The government has ensured the rights of the workers as well as the business interests of the business

men.

Social Security in Cost Estimates: An additional 10 percent of Social Security will be included in the cost estimate of new construction and consultancy services.

Additional Overhead: Up to 15 percent of the overhead amount may be included in the cost of purchasing a consulting service.

Opportunity for action and correction: Businesses that violate the rules will be issued a red card for the first time and given a chance to make corrections within 30 days. Those who commit serious negligence or fraud will be blacklisted and bill payment will be withheld.

Minister for Physical Construction and Infrastructure Sunil Lamsal has said that the achievement of development should not be limited only to the construction of roads, bridges and buildings, but should also be reflected in the standard of living of the workers who build these structures. Stating that workers and businessmen are partners in development, this procedure is expected to make the public procurement system more just, transparent and accountable.

Kathmandu.
