Kathmandu. KATHMANDU: The Supreme Court (SC) has issued an interim order not to proceed with the work of the Property Investigation Commission formed by the Rastriya Swatantra Party-led government. <\/p>\n
A division bench of Justices Tek Prasad Dhungana and Shreekanta Poudel issued the order demanding the dissolution of the commission. The interim order was issued on Friday after the hearing of the writ petition filed by Prem Raj Silwal. <\/p>\n
The government had also given the commission the responsibility of investigating the properties of former judges and former army officers. An interim order has been issued to stop such activities immediately.\u00a0The apex court has also ordered the commission to be submitted to the full bench of the Supreme Court for verdict on the demand for dissolution of the commission. <\/p>\n
Silwal had filed a writ petition at the apex court on May 29 questioning the legitimacy of the commission formed by the Council of Ministers led by Prime Minister Balendra Shah under the leadership of former justices of the Supreme Court. <\/p>\n
Nepal’s constitution excludes sitting judges and Nepal Army officers from the purview of property scrutiny. <\/p>\n
The petitioners have claimed that the decision to form the commission was illegal. It is claimed that the commission formed under the Inquiry Commission Act cannot investigate the property of individuals. Advocate Silwal has claimed that it would be unconstitutional for a former Supreme Court justice to head such a commission.<\/p>\n","protected":false},"excerpt":{"rendered":"
