Kathmandu. A French appeals court on Thursday found Airbus and Air France guilty of institutional manslaughter over the Rio-Paris crash.\u00a0At the request of prosecutors in an eight-week trial last year, the appeals court ordered them both to pay the maximum fine, $261,720, in restitution for institutional manslaughter. <\/p>\n
Although the fine is only a small part of the total income of the two companies, they will go to the Supreme Court for an appeal as it will affect their institutional image. <\/p>\n
The two French companies were acquitted by a lower court in a 2023 ruling. Both companies have repeatedly denied allegations of negligence on their part in the accident. <\/p>\n
Even though the Court of Appeal has overturned the lower court’s decision, the legal battle between the family of the deceased and the two companies will continue for the last 17 years. <\/p>\n
“Justice has been done completely,” said Daniel Lamy, president of the AF47 Victims’ Association, who was seen in the courtroom after the verdict. His son was one of the 228 people killed in the plane crash. <\/p>\n
According to French News, on June 1, 2009, during an equatorial storm, the Airbus A330 crashed in darkness in the Atlantic Ocean.\u00a0Thursday’s verdict is the latest milestone in a marathon of legal battles involving mainly French, Brazilian and German victims’ relatives and two of France’s most emblematic companies. <\/p>\n
The black boxes from Flight 447 were found in 2011 after two years of deep sea searching. <\/p>\n
The case exposed the bitter divide between the airline and the aircraft manufacturer over the gap between the cause of the crash and the wide range of causes and effects pointed out by the court, which focused primarily on the actions of the pilots. <\/p>\n
Analysts said the decision is unlikely to change regulators’ views on the crash, which did not lead to major technical changes. French crash investigators cut lift from under the wings and pushed their jet into a stall after the plane’s crew mishandled problems with the ice-up sensors. <\/p>\n
