Kathmandu. A writ petition has been filed in the Supreme Court against Governor Bishwanath Poudel on Tuesday. <\/p>\n
Advocates Ananta Raj Luitel, Bishal Thapa and Pratibha Upreti have filed a writ petition at the Supreme Court seeking cancellation of Poudel’s appointment. The writ petition was filed with the Supreme Court on Friday. <\/p>\n
According to the provisions of the Nepal Rastra Bank Act, 2058 BS, a person with no expertise has been appointed as the governor despite having mandatory expertise for the appointment of the governor. According to the writ petition, Poudel was a political personality and had resigned from the committee to become the governor when he himself was a member of the governor’s recommendation committee. “Therefore, the decision to recommend, appoint and administer oath to Poudel as governor is illegal,” reads the writ petition. <\/p>\n
Similarly, according to Article 133 (2) and (3) of the Constitution of Nepal, a mixed mandamus order has been issued prohibiting the government from carrying out any far-reaching work in the capacity of governor on matters of serious national importance, including signing of notes. <\/p>\n
The writ petition against Governor Poudel has been fixed for Wednesday. <\/p>\n
